A wayleave is a temporary right and the usual method by which electricity companies maintain their equipment. An easement is in place when the landowner has entered into an agreement to keep the apparatus/pipeline in place on a permanent basis.
It is usual for the landowner to be entitled to an easement payment or annual wayleave payment, together with compensation for crop loss, surface damage and disturbance. A rent may also be charged to utility companies for portable site storage on the land. In addition to the compensation payment, Katie will agree access routes, temporary fencing, location of gates, and reinstatement works required.
If the farmer has field drainage plans, then these are provided to the utility company, to help ensure that the land drainage is restored.
Katie's fees are paid by the utility company.
